1. WHO OPERATES SURF: ULTIMATE

Surf: Ultimate is operated by Ideate LLC ("Ideate," "we," "us," or "our"). These Terms govern your access to the Surf: Ultimate website, game, accounts, online features, and related services.

2. ELIGIBILITY

You must be at least 13 years old to create an account or use online services. If the law where you live requires a higher age for you to agree to these Terms, a parent or legal guardian must review and agree to them for you.

3. ACCOUNTS

You are responsible for keeping your account information accurate and secure. You may not sell, share, or transfer an account. Tell us promptly if you believe your account has been accessed without permission.

4. GAME ACCESS AND CONDUCT

We grant you a personal, limited, revocable, non-exclusive license to use Surf: Ultimate for personal entertainment. You may not cheat, exploit errors, disrupt services, harass other players, automate gameplay, access another person's account, or use the service in a way that violates applicable law.

5. DIGITAL COSMETICS

Surf: Ultimate may offer optional, one-time purchases of digital characters, surfboards, handheld items, and other cosmetics. A purchase grants a limited license to use that item within Surf: Ultimate. Digital items have no cash value, are not legal tender, cannot be withdrawn, and cannot be transferred between players. We do not currently offer recurring subscriptions.

6. PAYMENTS AND REFUNDS

Prices and applicable taxes are shown before purchase. Payments are processed by our payment provider. Refunds are governed by our Refund Policy and any rights required by law.

7. AVAILABILITY AND CHANGES

We may update, rebalance, add to, suspend, or discontinue parts of Surf: Ultimate to operate, secure, and improve the game. Online services may occasionally be unavailable. We do not promise that every feature will remain available forever.

8. OWNERSHIP

Surf: Ultimate, its software, artwork, game content, branding, and other materials are owned by Ideate LLC or used with permission. These Terms do not transfer ownership of that material to you.

9. ENFORCEMENT

We may restrict or terminate access when reasonably necessary to protect players, prevent fraud or abuse, comply with law, or enforce these Terms. We will consider the circumstances and applicable law when taking action.

10. DISCLAIMERS AND LIABILITY

Surf: Ultimate is provided on an "as available" basis to the extent permitted by law. Nothing in these Terms excludes rights or remedies that cannot legally be excluded. To the extent permitted by law, Ideate LLC is not liable for indirect, incidental, special, or consequential losses arising from use of the service.

11. CHANGES TO THESE TERMS

We may update these Terms as Surf: Ultimate changes. We will post the revised version and update the date above. Where required, we will give additional notice before material changes take effect.
