TERMS OF
SERVICE.

1. AGREEMENT AND OPERATOR

These Terms govern surfultimate.com, Surf: Ultimate, accounts, online play, leaderboards, purchases, and related services. The service is operated by Ideate LLC, 30 N Gould St, Ste N, Sheridan, WY 82801, United States. By using an account or online feature, you agree to these Terms.

2. AGE AND ELIGIBILITY

You must be at least 13 to create an account or use online services. If the law where you live requires a higher age to agree on your own, a parent or legal guardian must review and agree to these Terms. See the Age & Audience Policy.

3. ACCOUNTS AND DISPLAY NAMES

Sign-in uses email one-time codes or Google; Surf: Ultimate does not use passwords. Display names are first-come and unique. You are responsible for your account and may not sell, share, transfer, impersonate, or access another person's account. Contact security@surfultimate.com promptly about suspected unauthorized access.

4. GAME LICENSE

Ideate LLC grants you a personal, limited, revocable, non-exclusive, non-transferable license to play Surf: Ultimate for personal entertainment while these Terms remain in effect. You may create and monetize ordinary gameplay videos and streams, subject to third-party music or platform rules. You may not copy, sell, reverse engineer, or redistribute the game or its assets except where law expressly permits.

5. PLAYER CONDUCT

Do not cheat, falsify runs, exploit errors, evade sanctions, disrupt services, harass or threaten others, use hateful or sexually explicit names, spam, automate gameplay, probe private systems, or violate law. Report tools are for genuine concerns and must not be abused.

6. REPLAYS, LEADERBOARDS, AND MULTIPLAYER

Verified replay movement, times, display names, and equipped cosmetics may be shown on leaderboards, as ghosts, and during multiplayer. You grant Ideate LLC a worldwide, non-exclusive, royalty-free license to host, reproduce, transmit, and display this game-generated material only to operate and promote Surf: Ultimate. We may reject or remove records and restrict accounts to protect competitive integrity and players.

7. DIGITAL COSMETICS

Optional one-time purchases grant a limited account-bound license to use a digital character, board, handheld, or bundle inside Surf: Ultimate. Items provide no cash value or gameplay advantage, are not legal tender, cannot be withdrawn or traded, and do not transfer between accounts. Surf: Ultimate has no premium currency or recurring subscription at launch.

8. PRICES, TAX, AND CHECKOUT

Store prices include applicable indirect tax. Stripe/Link may display an equivalent local-currency price. For eligible transactions, Stripe/Link acts as merchant of record and handles checkout, tax, receipts, transaction support, fraud, refunds, and disputes. Before checkout, you must accept the current terms and explicitly request immediate digital delivery. See the Refund Policy.

9. REFUNDS AND DELIVERY

Delivered cosmetics are normally final and not refundable for a change of mind. This does not remove mandatory consumer rights. We correct duplicate charges, unauthorized charges, failed delivery, and billing errors, and honor any refund the law or Stripe/Link requires. A refunded, reversed, or charged-back purchase may remove its associated entitlement.

10. UPDATES AND AVAILABILITY

We may update, rebalance, secure, suspend, or discontinue parts of the game. Online services may be interrupted for maintenance, incidents, provider failures, or legal reasons. We do not promise that every online feature or cosmetic presentation will remain unchanged forever, but purchases remain governed by applicable consumer law.

11. OWNERSHIP AND THIRD-PARTY MATERIAL

Surf: Ultimate, its original software, artwork, branding, and game content are owned by Ideate LLC. Some assets are used under third-party licenses listed on the Credits page. These Terms do not transfer ownership of that material to you.

12. ENFORCEMENT AND APPEALS

We may hide a name, remove a replay, restrict submissions or leaderboards, suspend online access, or terminate an account when reasonably necessary to enforce these Terms, prevent abuse or fraud, protect users, or comply with law. To ask for review of an action, email support@surfultimate.com with the relevant account and decision details.

13. DISCLAIMERS AND LIABILITY

Surf: Ultimate is provided “as available” to the fullest extent law permits. Nothing here excludes a warranty, remedy, or liability that cannot legally be excluded. To the extent permitted by law, Ideate LLC is not liable for indirect, incidental, special, punitive, or consequential loss, or loss caused by events outside its reasonable control.

14. GOVERNING LAW

Wyoming law governs these Terms without regard to conflict-of-law rules, except that mandatory consumer protections and courts available in your home country or region remain unaffected. Before filing a claim, please contact us so we can try to resolve it.

15. CHANGES AND SEVERABILITY

We may update these Terms and will post the new date here. Where required, we will provide additional notice before a material change applies. If one part is unenforceable, the remaining parts continue to apply.
